Welcome to TrustNode Inc. ("TrustNode", "Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website located at https://trustnode.app (the "Site") and all associated mobile applications, software, tools, and digital educational services developed or operated by TrustNode Inc. (collectively, the "Services").

By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease accessing the Site and uninstall all TrustNode mobile applications.

1. Eligibility and Accounts

  • Age Requirements: You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use our Services. If you are under the age of majority in your province, state, or country of residence, you must review these Terms with your parent or legal guardian.
  • Account Responsibility: If an application offers account creation or cloud sync features, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

2. Educational and Exam Preparation Disclaimer

Please read this section carefully:

  • Independent Study Tools: All study materials, practice questions, simulated mock exams, and explanations provided within our applications are created by TrustNode Inc. as supplemental educational resources.
  • No Official Government Affiliation: TrustNode Inc. is an independent software publisher and is not affiliated with, sponsored by, or endorsed by any governmental agency, department, licensing bureau, or official regulatory body (including, but not limited to, Immigration, Refugees and Citizenship Canada (IRCC), the Ontario Ministry of Transportation (MTO), state Departments of Motor Vehicles (DMV), or official testing administrators).
  • No Guarantee of Passing: While our practice exams are designed to closely simulate real exam formats, TrustNode Inc. makes no representation or guarantee that using our Services will ensure a passing score on any official licensing exam or government test. Users are strongly encouraged to cross-reference official government handbooks and regulatory guidelines.

3. Subscriptions, In-App Purchases, and Billing

Certain features, question banks, ad-free modes, and advanced test simulations require a paid subscription or one-time In-App Purchase ("IAP").

A. Billing and Processing

  • All purchases are billed and processed directly through the Apple App Store (for iOS devices via Apple Inc.) or Google Play Store (for Android devices via Google LLC).
  • Pricing is clearly displayed within the application prior to purchase and may vary by territory or local currency.

B. Auto-Renewable Subscriptions

  • Renewal Terms: If you purchase an auto-renewing subscription (for example weekly, monthly, or annual access), your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours prior to the expiration of the current cycle.
  • Managing Subscriptions: You can manage or cancel your subscription at any time directly through your device settings.
  • iOS: Settings > [Your Name] > Subscriptions.
  • Android: Google Play Store > Profile Icon > Payments & Subscriptions > Subscriptions.

C. Free Trials

If a free trial is offered, you will have access to premium features for the duration of the trial period. Unless cancelled before the trial ends, your payment method will be charged for the subscription at the end of the trial period.

D. Refunds

Since billing is managed exclusively by Apple and Google:

  • Apple App Store: All refund requests must be submitted directly to Apple at reportaproblem.apple.com.
  • Google Play Store: Refund requests must comply with Google Play's standard refund policies.

4. Intellectual Property Rights

  • Ownership: All software, code, user interfaces, design, graphics, quiz questions, audio, visual elements, and trademarks (including the "TrustNode" name, logo, and brand marks) are the exclusive intellectual property of TrustNode Inc. and are protected by Canadian and international copyright and trademark laws.
  • Limited License: We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use our applications on your personal mobile devices strictly for non-commercial educational purposes.

Restrictions: You agree not to:

  • Copy, scrape, reproduce, redistribute, or reverse-engineer any part of the Services or test questions.
  • Use automated systems (bots, spiders) to extract content or data from our Services.
  • Resell, rent, lease, or commercially exploit any part of the applications.

5. User Conduct

You agree to use our Services only for lawful purposes. You agree not to attempt to interfere with the proper working of the apps, circumvent security or subscription paywalls, or transmit malicious code or viruses.

6. Termination

We reserve the right to suspend or terminate your access to our Services at any time, without prior notice, if you violate these Terms or engage in fraudulent or abusive activities.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TRUSTNODE INC. DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRUSTNODE INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TRUSTNODE INC.'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU TO TRUSTNODE INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless TrustNode Inc. and its directors, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or your misuse of the Services.

10. Governing Law and Dispute Resolution

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms.
